You are here: Home / Terms and Conditions

These general terms and conditions of sale apply to purchases of wines and olive oils made by private customers on the online shop chateautremouries.com. By confirming your order, you accept them. They do not cover the rental of our gîtes or events at the estate, which have their own conditions. The French version of these terms prevails in case of dispute.

1. The seller

Château Trémouriès, 1698 Route de la Mole, 83310 Cogolin, France.
Wine-growing estate operated by PIALUX INVEST S.A., registered with the Fréjus Trade and Companies Register under number 409 574 050, EU VAT number FR76409574050.
Phone: +33 4 94 54 66 21
Email: chateau.tremouries83@gmail.com

2. No sale of alcohol to minors

French law prohibits the sale of alcoholic beverages to minors (article L3342-1 of the French Public Health Code). By ordering wine, you certify that you are at least 18 years old. We may ask for proof of age and refuse or cancel an order if in doubt.
Alcohol abuse is dangerous for your health. Please drink responsibly.

3. Products

Each product page states the appellation, colour, vintage, packaging and price. Photos are for illustration only: the label may change from one vintage to the next. Products are sold while stocks last. If an ordered product is no longer available, we let you know and refund that part of the order, or offer you another vintage with your agreement.

4. Prices

Prices are shown in euros, including all taxes. Delivery costs are added to the price of the products and shown to you before you confirm your order. We may change our prices at any time; the price charged is the one displayed when you place your order.

5. Ordering

  1. Add the products to your basket.
  2. Log in to your customer account, or create one: an account is required to order.
  3. Enter your delivery address and choose your payment method.
  4. Read and accept these terms, then confirm your order.

You then receive an email summarising your order. We may refuse an abnormal order, an order placed in bad faith, or an order from a customer with whom a payment dispute is ongoing.

6. Payment

Two payment methods are available:

  • PayPal, with or without a PayPal account: you can pay by bank card. Payment is processed on PayPal’s secure servers; we never have access to your card details.
  • Cheque, to be sent to Château Trémouriès, 1698 Route de la Mole, 83310 Cogolin, France. We ship the order once the cheque has cleared.

The products remain our property until the price has been paid in full.

7. Delivery

We deliver within mainland France, by express carrier, to the address given with the order. Delivery costs:

  • €32 for orders up to €120;
  • €65 for orders from €120 to €269;
  • free delivery above €269.

We prepare and ship your order once payment has been received. Unless another date has been agreed with you, delivery takes place no later than 30 days after the order (article L216-1 of the French Consumer Code). If delivery is late, you can ask us to deliver within a reasonable time, then cancel the order if that deadline is missed; we then refund you within 14 days.

The products travel at our risk until they are handed to you. Check the parcel in front of the driver and write down your reservations if anything is broken: the procedure is described in our refund and returns policy.

8. Right of withdrawal

You have 14 days from receipt of your order to withdraw, without giving any reason (articles L221-18 and following of the French Consumer Code). Return shipping costs are your responsibility. We refund the price of the products and the original delivery costs no later than 14 days after your decision, once we have received the products or proof that you have sent them. Bottles must come back intact and unopened.

Full details and the model withdrawal form are in our refund and returns policy.

9. Legal guarantees

You benefit from the legal guarantee of conformity for 2 years from delivery (articles L217-3 and following of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 and following of the French Civil Code). If a product is defective, you can ask for a replacement, or failing that a price reduction or a refund. Contact us by phone or email to use these guarantees.

10. Liability

We are not liable for a failure caused by force majeure, by a third party unrelated to the order, or by an error on your part in the delivery details. Store our wines lying down, away from light and at a stable temperature: we cannot be held responsible for deterioration caused by poor storage after delivery.

11. Personal data

We use the information you give us (name, addresses, email, phone) to process your order, deliver it, keep you informed and keep our accounts. Only our payment and delivery providers receive it, for what concerns them. We never sell or rent it. Under the EU General Data Protection Regulation (GDPR), you can access, correct or delete your data, or object to its use, by writing to chateau.tremouries83@gmail.com. You can also contact the French data protection authority, the CNIL (cnil.fr).

12. Disputes and applicable law

These terms are governed by French law. If a problem arises, please contact us first: we will look for an amicable solution with you. Failing that, the dispute will be brought before the competent courts.
